Terms of Service

These terms of service apply to every purchase made on boravexti.com, an online shop operated by D-Donkey UG (haftungsbeschränkt), Tweder Berg 20, 24944 Flensburg, Germany ("boravexti", "we", "us", "our"). By placing an order or otherwise using our website, you agree to these terms.

1. Who We Are
boravexti.com is operated by D-Donkey UG (haftungsbeschränkt), registered with the Amtsgericht Flensburg under registration number HRB 18017 FL, represented by managing director Mick Hannibal Christiansen. Full contact details are available in our legal notice.

2. Eligibility
By using our website and placing an order, you confirm that you are at least 18 years old, or that you have the consent of a parent or legal guardian.

3. Conclusion of Contract
The products shown on our website are not a binding offer on our part, but an invitation for you to place an order. When you submit an order, you are making us a binding offer to purchase the selected products. After you place your order, we will send you an email confirming that we have received it. This confirmation does not yet mean your order has been accepted. A contract is only formed once we send you a separate email confirming that your order has been accepted, or once we ship the goods to you, whichever happens first.

4. Prices and Payment
All prices shown on our website are in euros and include statutory German value added tax, where applicable, unless stated otherwise. Delivery costs are shown separately during checkout before you complete your order. Payment is due at the time you place your order, using one of the payment methods offered at checkout.

5. Delivery
We currently ship exclusively within Germany. Delivery timeframes and shipping costs are set out in our shipping policy. Please make sure the delivery address you provide is complete and correct, as we cannot guarantee changes once an order has been dispatched.

6. Retention of Title
The goods you purchase remain our property until full payment has been received.

7. Right of Withdrawal
If you are a consumer, you have a statutory right to withdraw from your purchase. The details, including the withdrawal period and how to exercise this right, are set out in our returns and refunds policy, which forms part of these terms.

8. Warranty
We are liable for defects in our products in accordance with the applicable statutory provisions, in particular the German Civil Code (BGB). This means that if a product you receive is defective, you are entitled to have it repaired or replaced, and, depending on the circumstances, to a price reduction or to withdraw from the contract. Your statutory warranty rights are not affected by our returns and refunds policy.

9. Limitation of Liability
We are liable without limitation for damage caused intentionally or through gross negligence, and for damage arising from injury to life, body, or health. For damage caused by slight negligence, we are only liable if we have breached a material contractual obligation, in which case our liability is limited to the damage that was foreseeable and typical for this kind of contract. This limitation does not affect any liability under the German Product Liability Act.

10. Intellectual Property
All content on our website, including text, product descriptions, images, graphics, and logos, is protected by copyright and belongs to us or our licensors. You may not copy, reproduce, or use this content for commercial purposes without our prior written consent.

11. Governing Law and Jurisdiction
These terms are governed by the law of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of any protection granted to you by mandatory provisions of the law of the country in which you have your habitual residence. If you are a business customer, the place of jurisdiction for any disputes arising from this contract is Flensburg, Germany.

12. Changes to These Terms
We may update these terms from time to time to reflect changes in our services or in the law. The version published on this page at the time you place your order is the one that applies to that order.
